Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") are an agreement between you and GodSparx, operated by Justin and Calie Cook, a sole proprietorship based in Thomson, Georgia, United States. They govern your use of godsparx.com and any related services (together, the "Platform"). By creating an account or using the Platform, you agree to these Terms, our Privacy Policy, Content Policy, and Community Guidelines. If you don't agree, please don't use GodSparx.

2. Eligibility

• You must be at least 16 years old to create an account or use the Platform.
• If you are 16 or 17, a parent or legal guardian must consent before your testimony is published.
• You must not have been previously banned from GodSparx.
• By using the Platform you confirm the above is true.

3. Your account

• Sign-in is passwordless: we email you a one-time magic link. Keep your email account secure — anyone with access to your inbox could access your GodSparx account.
• Provide accurate information, and use a name or display name you're entitled to use. Pseudonyms are allowed for privacy (see the Content Policy), but impersonating a real person or organization is not.
• One account per person. You're responsible for activity that happens under your account.
• Tell us right away at hello@godsparx.com if you suspect unauthorized access.

4. Your content and your license to us

You retain full ownership of everything you post — testimonies, sparks, comments, photos, and (in the future) videos ("Your Content").

So that we can operate and promote the Platform, you grant GodSparx a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt (for example, cropping a video into a clip or pairing text with a graphic), display, and distribute Your Content:

• on the GodSparx platform — feeds, profiles, search, and reasonable technical copies (backups, thumbnails, responsive sizes); and
• on GodSparx's official social media accounts — currently Facebook, Instagram, and TikTok (@GXGodSparx) — to feature and promote your testimony so it reaches more people. When you submit a story, you confirm this consent with a checkbox, and any social share always uses the byline you chose (including "Anonymous" if that's your choice).

This license still comes with hard limits we hold ourselves to:

• Your Content will never be sold.
• Your Content will never be used to advertise anyone else's products or services. Featuring your story on our own channels to spread testimonies is the only promotion we do with it.
• Your Content will never be syndicated, licensed, or republished to third-party publications without your prior written consent. If we ever want to feature your story somewhere beyond GodSparx and our own social channels (a book, another publication), we will ask you first, in writing, and you can say no with zero consequences.

The license ends when you delete the content or your account, except for the short period needed for backup systems to cycle (see Section 6) and any copies others made while it was public (e.g., screenshots — which we can't control). If your story was shared on our social channels and you delete it or ask us at hello@godsparx.com, we will remove those social posts too, promptly.

You promise that Your Content is yours to post: you created it or have permission, and it doesn't violate anyone else's rights, including the privacy and image rights of people who appear in your photos or videos (see the media-consent rules in the Content Policy).

5. Moderation

Every testimony and spark is reviewed by a human before it's published. We may, at our discretion:

• approve, decline, or request edits to submitted content;
• add editorial notes or sensitive-content screens;
• remove published content that violates our Content Policy;
• suspend or terminate accounts for serious or repeated violations.

Moderation decisions follow the enforcement ladder and appeal process in the Content Policy. We aim to be transparent and kind, but we reserve final judgment about what appears on the Platform.

6. Deletion means deletion

When you delete a testimony, spark, comment, or your entire account, that content is permanently removed from the Platform, including uploaded photos and media files. Removal from public view is immediate; purging from our systems, including rolling backups, completes within 30 days. We do not keep a hidden archive of deleted stories. The only exceptions are records we're legally required to keep and copies others made while the content was public.

7. Prohibited conduct

You agree not to:

• post fabricated testimonies or otherwise deceive the community (see the Content Policy for full content rules);
• harass, threaten, demean, or dox anyone;
• use the Platform for fundraising, solicitation, multi-level marketing, or commercial promotion;
• use the Platform for political campaigning;
• upload malware, scrape the site, harvest user data, or interfere with the Platform's operation or security;
• access another person's account or misrepresent your identity as a real person you are not;
• use automated tools (including AI) to mass-generate content or engagement;
• violate any applicable law.

8. Copyright and DMCA

We respect intellectual property and expect the same from our community. If you believe content on GodSparx infringes your copyright, send a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice should include: identification of the copyrighted work, the URL of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you're authorized to act, and your physical or electronic signature. We remove infringing content when properly notified and terminate repeat infringers. If your content was removed and you believe it was a mistake, you may send a counter-notice to the same address.

9. Testimonies are not medical or financial advice

This one matters, so please read it carefully. Testimonies on GodSparx are personal accounts of individual experiences. They are not medical, psychological, legal, or financial advice, and they are not a substitute for professional care.

• Never stop, delay, or change medical treatment because of a story you read here. If a testimony describes healing, that is one person's experience — talk to your doctor about your own.
• Stories about financial provision are not investment or financial guidance.
• If you are in crisis, contact emergency services or a crisis line (in the US, call or text 988) — not a comment section.

10. Disclaimers of warranties

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Platform will be uninterrupted, error-free, or secure, or that any content — even human-moderated content — is accurate, complete, or reliable. Human moderation is a good-faith review for policy compliance, not a verification of the factual accuracy of any testimony.

11. Limitation of liability

To the fullest extent permitted by law, GodSparx and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to $100 USD or the amount you paid us in the past twelve months, whichever is greater (GodSparx is currently free, so that will usually be $100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent the law allows.

You agree to indemnify us against claims arising from Your Content or your violation of these Terms, to the extent permitted by law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Courts located in that state will have exclusive jurisdiction over disputes, and you and we each consent to their jurisdiction.

Either way, before any formal dispute, please email hello@godsparx.com — most problems can be solved with a conversation.

13. Termination

• By you: you can delete your account at any time, and Section 6 applies — your content is permanently removed.
• By us: we may suspend or terminate accounts that violate these Terms or our policies, following the enforcement ladder in the Content Policy where practical, or immediately for severe violations (threats, exploitation, illegal content).
• Sections that by their nature should survive termination (content ownership, disclaimers, limitation of liability, governing law) survive.

14. Changes to these Terms

We may update these Terms as the Platform grows (for example, when video launches or SMS begins). For material changes we'll give notice — by email or a prominent notice on the site — at least 14 days before they take effect. Continuing to use GodSparx after that means you accept the updated Terms. The "Last updated" date at the top always reflects the current version.

15. Everything else

These Terms plus the linked policies are the entire agreement between us. If any provision is found unenforceable, the rest remain in effect. Our not enforcing a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a change of ownership of the Platform, with notice to you.
